LCPS Statement on Policy 8040
On Wednesday, August 11, 2021, the Loudoun County School Board approved Policy 8040: Rights of Transgender and Gender-Expansive Students by a vote of 7-2 after minor amendments were made. The School Board developed Policy 8040 to meet the requirements of Virginia House Bill 145 and Virginia Senate Bill 161, enacted by the 2020 Virginia General Assembly. This legislation created Section § 22.1-23.3 of the Code of Virginia, treatment of transgender students. This Code section states that each Virginia school board shall adopt a policy that reflects the requirements set forth by the Code.
Information regarding minor amendments to the presented policy and how this policy will be implemented by Loudoun County Public Schools will be made available to the public after review of the meeting transcript by the Clerk of the Board. Review Policy 8040 as presented to the School Board. LCPS’ number one priority is to foster the success of all students and ensure they feel safe, secure, accepted and ready to learn at school. The school division will continue to do its due diligence in creating that environment and remaining open and transparent with all LCPS partners, community members and stakeholders.
