Subpoena of Student Records
Loudoun County Public Schools will release student records without consent to comply with a judicial order or a lawfully issued subpoena as allowed by FERPA disclosure rules. There is no charge for these records.
Active Records - current 2016/2017 students
Inactive Records - former students from 2011/2012 through 2015/2016 school years
Active and Inactive student
records are housed at the last school attended by the student, making the
school principal the Custodian of Records. Subpoenas should be issued to the
principal at the appropriate school address.
Archived Records – former students from 2010/2011 school year and before
Archived student records are housed at the Student Records Office at Round Hill Center. Subpoenas should be issued to Student Records Manager, Loudoun County Public Schools, Round Hill Center, 20 High Street, Round Hill, VA 20141.
The student record will be located within 24 to 48 hours. Prior to releasing the student record, the parent(s), guardian(s), or adult student will be notified in writing that Loudoun County Public Schools intends to respond. The purpose of this notice is to provide the opportunity to ask the court to withdraw the request for records (this process is known as “filing a motion to quash”). If a motion to quash is filed, no further action will be taken until the court has issued a decision. If a motion to quash is not filed, the student record is then mailed or hand-delivered, depending on the time frame, to the issuer of the order or subpoena.
